Please ensure you read and understand the following terms and conditions pertinent to your accommodation. If you have any questions regarding these terms and conditions, do not hesitate to contact us.
Windsor Palms iis a privately owned home owned by Barbara Wignall, herein after called 'The Owners'. Our local management company, herein after referred to as ‘The Management Company’.
YOUR BOOKING
After making a reservation with us, the party leader who must be 21 years old or over, must complete our booking form and sign on behalf of all members of the party that these booking conditions together with our Terms & Conditions, and general information have been read and accepted. The accommodation is booked solely for the use of the guests named on the booking form. Due to State fire regulations in Florida, the maximum occupancy as advised by us must not be exceeded.
To confirm your booking, we will require a non-refundable deposit of US$600/£400 per booking within 7 days of our verbal confirmation of your arrangements. A higher deposit may be required for premium dates, or for longer stays exceeding 2 weeks. Your booking is confirmed once ‘The Owners’ have received your deposit and booking form, signing of the booking form is taken as acceptance of these terms and conditions and the confirmation invoice has been issued by us. No further invoice will be issued, therefore it is ‘The Clients’ responsibility to make a note of the balance due date.
PAYING THE BALANCE
The balance of your rental cost is payable 12 weeks prior to your arrival in Florida. Where payment in full has not been made by this date, we reserve the right to cancel the booking and cancellation charges as detailed below will apply. If you book within 10 weeks, we will require full payment at the time of booking.
WHAT'S INCLUDED
‘The Client’ has use of the property including all utilities except pool heating, for which a supplement is payable. The maximum occupancy is 8 persons ;.
Your vacation home is cleaned and prepared for your arrival. It is the clients’ responsibility to keep the property clean, and to change and wash bed linen and towels (which are supplied) during your stay.
Our home is strictly No-smoking; guests are allowed to smoke outside, and within the pool screen area please use ashtrays provided
Strictly No Pets allowed.
My vacation home is available from 4.00PM local time on the day of your arrival. We ask that you vacate the property by 10.30AM on the day of your departure, leaving it in a tidy condition to enable our cleaners to prepare for our newly arriving guests.
SECURITY DEPOSITS
We understand that accidents do happen, but we do ask that you inform our ‘Management Company’ of any defects, or breakages as soon as possible and pay for the repair or replacement so that neither you nor the following guests are inconvenienced.
A returnable security deposit of US$500//£350.00 in the form of a credit card is required when you make your final payment. This credit card details will be held to cover or part cover any breakages, excess cleaning costs or damage to the property. ‘The Owners’, less any deductions to cover the cost of replacement or repair.At the end of the rental period subject to inspection. Your credit cards details are destroyed
Our local ‘Management Company’ checks the home before your arrival, and again after your departure. ‘The Owners’ are advised of any damage, breakages or faults, this may include additional cleaning costs for removal of stains due to spillage.
In the event of any excess damage of any kind to the property, or excess cleaning costs or excessive use of electricity (e.g. leaving external doors open with the Air Conditioning on) which exceed the security deposit, the signatory will be held responsible for the additional costs, this amount will be invoiced and payable in full immediately.
I reserve the right to retain the security deposit (either in part or full) to cover damage or non return of keys. Receipts for repairs/replacement will be provided in the unlikely event that such retention is necessary.
All cancellations must be notified in writing to ‘The Owners’, cancellations by e-mail cannot be accepted. If the client cancels for any reason, the following charges will apply:-
- Up to 10 weeks before departure - Loss of booking deposit only
- Within 10 weeks of Rental Period - Loss of 100% of total amount
IF WE CHANGE YOUR ACCOMMODATION
Occasionally it may be necessary to cancel your booking through reasons beyond our control and we reserve the right to do so. We will inform you as soon as possible and offer you the choice of alternative accommodation through our ‘Management Company’ of a similar standard or a refund of all monies paid, (without interest, compensation, or consequential loss of any kind) providing it does not arise for reasons of 'Force Majeure'.
FORCE MAJEURE
No liability can be accepted for events, which are 'force majeure'. These include, but are not limited to war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural or nuclear disaster, fire, adverse weather conditions or other events outside our control.
LIABILITY
‘The Owners’ or ‘Management Company’ accept no liability whatsoever for any injury or death, however caused, as a result of the use of any equipment in the Villa or Swimming Pool area. This extends to any other visitor to the home or swimming pool, or for any loss or damage howsoever caused to any property brought to the premises.
‘The Owners’ and their agents reserve the right of entry at anytime. (This includes such workers as pool maintenance, gardeners, etc...)
SWIMMING POOL
The Swimming pool area is used entirely at ‘The Clients’ own risk, the doors and windows opening on to this area are alarmed, under no circumstances are these to disabled or tampered with. No diving is allowed, and children must be supervised at all times whilst in the pool area. No Glassware is permitted in the pool area, please utilise the plastic items provided.
POOL HEATING
The heater is a mechanical device, as with any mechanical device it can be subject to electrical/mechanical failure. If such a case arises, we request you contact our’ Management Company’, who will make every effort to have repairs made to the heater. If the guest has paid for pool heating ‘The Owners’ will refund only the days that the pool heating was faulty or unavailable. Pool temperature is affected by the weather conditions, the colder the weather the longer it will take to heat the pool. A pool cover is provided for use by ‘The Client’ this assists with maintaining the pool temperature, and avoids excessive heating costs, excessive pool heating costs maybe recovered by ‘The Owners’ if the pool cover is not used.
HOME ALARM
Leaving the home. Details of alarm codes will be supplied when the final payment has been paid The home is fully alarmed and guests should set the alarm at all time. Any call outs made to our management company due to misuse of the alarm system will be deducted from the security deposit -
GAMES ROOM
There is a games room at our home which all of our guests are able to use, however,
Florida Palm will accept no responsibility whatsoever for any accident - injury - however caused whilst using the games room equipment. By booking our home all guests agree to this.
IN CASE OF COMPLAINT
While it is unlikely that you should have a complaint about my beautiful home, occasionally things do go wrong. If you have a problem during your stay, you MUST inform our ‘Management Company’ immediately who will endeavour to rectify the matter. We will not accept liability for any dissatisfaction or other complaint not reported to our ‘Management Company’ during your stay.
INSURANCE
It is vital that you have adequate comprehensive insurance cover for you and all members of your party. Check that any policies you are considering do in fact cover you for rented accommodation booked independently of travel arrangements.
No responsibility is accepted for any death, illness, loss, or damage to property and/or motor vehicles howsoever caused.
WEB SITE
Our web site is a guide to the quality, and description of our holiday home and its facilities. No liability is accepted for unintentional errors, mistakes, or omissions, which may arise because of subsequent changes.
DEPARTURE DOCUMENTATION
Approximately 21 days before arrival, we will send you details, giving directions to your home. The key is provided in a 'lock box' facility, and you will be given a security code. The security code will be needed in order to allow you to access the security box, which holds the key to the home. The security box is easy to access and can be found at the entrance to the property. Please remember to take these details with you otherwise access to our holiday home cannot be guaranteed.
